A 66-year-old Hilo man was sentenced Wednesday to six months in jail and five years probation on two sex assault charges.
A 66-year-old Hilo man was sentenced Wednesday to six months in jail and five years probation on two sex assault charges.
In a deal with prosecutors, Jaime Paul Yagin pleaded guilty to third-degree sex assault and attempted third-degree sex assault. He was originally indicted in September 2012 for third-degree sex assault and attempted second-degree sex assault, but the plea agreement reduced the second charge.
According to the indictment, Yagin knowingly subjected an underage girl to sexual contact between July 22, 2004, and July 21, 2006. The victim is now an adult.
Both charges Yagin pleaded guilty to are Class C felonies punishable by up to five years in prison. Yagin has no prior felony convictions.
Yagin told Hilo Circuit Judge Glenn Hara that he “made a mistake” and “have remorse.”
“I think the mistake you made was you got caught,” the judge told Yagin.
In addition to the probation and jail term, Hara ordered Yagin to register as a sex offender and to undergo a psychosexual evaluation and sex offender treatment. He also ordered that Yagin have no contact with the victim or her family, that he not live in a household with minors and that he not frequent any areas where minors congregate. He also ordered Yagin to repay the state $4,430 for extraditing him from Las Vegas.
